Over fierce objections from homeless advocates and service providers, Fremont, the Bay Area’s fourth-largest city, has adopted one of the strictest encamping bans anywhere in the region and California.

Fremont has enacted one of the most restrictive homeless encampment bans in California, sparking backlash from advocates and nonprofits who fear the ordinance could criminalize efforts to help those who are unhoused.

Outreach workers in the California city of Fremont worry the new homelessness ordinance could target them, despite assurances from the city.

The ordinance, which allows the city to fine those who help the homeless and makes it illegal for homeless people to camp on public property, was approved in a 6-1 vote after more than two hours of public comments.

The new anti-camping ordinance in Fairfax will not be enforced until at least next month because of a federal lawsuit by a homeless inhabitant of Peri Park.

The council is considering passing an ordinance that would restrict camping on both public and private property. It would also prohibit “permitting, aiding, abetting or concealing” someone who is camping. Violators could face a fine of up to a thousand dollars or six months in jail.
